Welcome to HOOM. These Terms of Service ("Terms") govern your access to and use of the HOOM mobile application, website, and related services (collectively, the "Service") provided by HOOM Inc., a Delaware corporation ("HOOM," "we," "us," or "our").
By accessing or using HOOM, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to create an account or use HOOM. By using the Service, you represent that you meet this requirement.
2. Description of the Service
HOOM provides digital wellness experiences designed to help you regulate your internal state through guided humming sessions, breathing guidance, visual cues, and shared participation. The Service may include:
- On-demand solo sessions and targeted Moments
- HOOM Together: live sessions with people you are connected with
- Daily Global HOOM: a daily session synchronized for participants around the world
- Send a hum: short voice recordings you can send to another member or share by link
- Profiles, usernames, connections, and share links
- Educational content related to nervous system regulation
HOOM may add, change, or remove features at any time.
3. Not Medical Advice
HOOM is not a medical device and does not provide medical advice, diagnosis, or treatment. The Service is intended for general wellness purposes only. Consult a qualified healthcare professional before making decisions related to your health. If you have a medical, breathing, neurological, or mental health condition, consult your doctor before using HOOM. Never disregard professional medical advice because of something you read or experienced in the Service.
4. Accounts
To use most features you must create an account. You agree to provide accurate information, keep your login credentials secure, and notify us if your account is compromised. You are responsible for all activity under your account. Your username must not impersonate another person or entity, infringe anyone's rights, or be offensive. HOOM may reclaim or change usernames that violate these Terms.
You may delete your account at any time from within the app or by emailing support@hoominc.com.
5. Your Content
The Service lets you create and share content, including your profile photo, username, hum avatar, and hums you send to others ("Your Content"). You own Your Content.
By submitting Your Content, you grant HOOM a worldwide, non-exclusive, royalty-free license to host, store, transmit, reproduce, and display Your Content as necessary to operate the Service, including delivering it to the people you send it to and displaying it to other participants as described in our Privacy Policy. This license ends when Your Content is deleted from the Service, except where it has been shared with others who have not deleted it, or where retention is required by law.
You represent that you have the rights to Your Content and that it does not violate these Terms or anyone else's rights. Your profile photo and hum avatar must be of you.
HOOM does not claim ownership of Your Content.
6. Community Rules
HOOM is a place to feel better together. When using profiles, connections, hums, HOOM Together, the Daily Global HOOM, or any other shared feature, you agree not to:
- Harass, threaten, intimidate, or bully anyone
- Send unwanted, repeated, or abusive hums or connection requests
- Share content that is sexual, hateful, violent, or discriminatory, or that promotes self-harm
- Impersonate any person, or use another person's image or voice as your own
- Record, capture, or redistribute another participant's voice or image from a session or a hum without their permission
- Use the Service to advertise, spam, solicit, or recruit
- Share hums or links with people who have not agreed to receive them, in violation of applicable law
- Collect information about other members, or attempt to identify or locate a member without their consent
- Use HOOM for any unlawful purpose, interfere with the Service, reverse engineer it, distribute malicious code, or access it with bots or automated tools
You can mute, block, or report any member. HOOM may review reported content, remove content, restrict features, or suspend or terminate accounts that violate these rules, with or without notice. We are not obligated to monitor content but may do so.
7. Live Sessions
HOOM Together sessions transmit your voice to the other participants in real time. Anyone you are in a session with can hear you. You are responsible for what you say and for your surroundings during a session. HOOM does not guarantee that other participants will not record a session, and you should not join sessions with people you do not trust.
The Daily Global HOOM may display your profile photo to other participants and include your approximate location in aggregate results.
8. Share Links and Referrals
Share links you send contain an identifier for your account, and HOOM may show you counts of people who joined through your link. Referral features are provided for enjoyment only; HOOM does not pay for referrals, and referral counts do not constitute credit, currency, or a right to any benefit. HOOM may adjust or remove referral counts it believes were obtained through spam or abuse.
9. Payments and Subscriptions
HOOM is currently free. If we introduce paid features or subscriptions, we will tell you the price before you are charged. Purchases will be billed through the platform used to purchase (Apple App Store, Google Play, or a web payment processor), subscriptions will renew automatically unless canceled before the renewal date, and refunds will be governed by the policies of that platform.
10. Intellectual Property
All content within HOOM, including animations, audio guidance and companion voices, branding, software, visual designs, text, and graphics, is the property of HOOM Inc. or its licensors and is protected by intellectual property laws. Except for Your Content, you may not copy, reproduce, distribute, or create derivative works from the Service without our written permission. HOOM and the HOOM logo are trademarks of HOOM Inc.
If you send us feedback or suggestions, we may use them without obligation to you.
11. Third-Party Services
The Service may rely on or link to third-party services, including app stores, sign-in providers, and your device's messaging and sharing tools. Your use of those services is governed by their terms, and HOOM is not responsible for them.
12. Termination
HOOM may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service and delete your account at any time. Sections 5, 10, and 13 through 17 survive termination.
13. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. HOOM does not guarantee that the Service will be uninterrupted, error-free, or secure, that any content from other members is accurate or appropriate, or that using HOOM will produce any particular result.
14. Limitation of Liability
To the fullest extent permitted by law, HOOM Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the Service or from the conduct or content of other members. To the fullest extent permitted by law, our total liability to you for all claims relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars.
15. Indemnification
You agree to defend, indemnify, and hold harmless HOOM Inc. and its officers, directors, employees, and agents from any claims, damages, and expenses, including reasonable attorneys' fees, arising from Your Content, your use of the Service, or your violation of these Terms or anyone's rights.
16. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction.
17. Changes to Terms
We may update these Terms periodically. If we make material changes, we will update the date at the top of this page and, where appropriate, notify you within the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
